MARULA REHAB TELEHEALTH – TERMS OF SERVICE (TOS)

These Terms of Service (“Terms”) govern your use of Marula Rehab Telehealth’s website, telehealth platform, services, and related systems. By accessing or using our services, you agree to these Terms.

Marula Rehab Telehealth (“we,” “us,” “our”) is a Utah-licensed virtual behavioral-health and substance-use-disorder treatment provider. All services are delivered exclusively through secure telehealth technology. If you do not agree to these Terms, you may not use our services.

1. Eligibility for Services

To receive services, you must:

  • Be physically located in Utah during all telehealth sessions
  • Be 18 years or older (or meet youth eligibility requirements)
  • Have the capacity to consent to treatment
  • Have access to a private space and internet-enabled device
  • Complete intake, identity verification, and consent forms
  • Agree to comply with all program policies

We may decline or discontinue services if eligibility requirements are not met.

2. Telehealth Service Requirements

By using our telehealth services, you agree to:

  • Maintain a private, quiet, safe environment during sessions
  • Not participate while driving or operating machinery
  • Use your own device or a secure device you control
  • Ensure your device has functioning audio and video
  • Allow identity and location verification at each session

We may reschedule or terminate a session if privacy or safety cannot be ensured.

3. Technology Limitations

You understand and agree that:

  • Telehealth relies on internet connectivity
  • Technical issues may interrupt sessions
  • We are not responsible for outages, dropped calls, or device failures
  • You must notify us if you cannot reconnect
  • Emergency procedures may be initiated if safety concerns arise

4. Client Responsibilities

You agree to:

  • Provide accurate information
  • Attend scheduled appointments
  • Notify us of cancellations at least 24 hours in advance when possible
  • Participate actively in treatment
  • Follow your treatment plan
  • Treat staff and other clients respectfully
  • Not record sessions
  • Not share group information outside the group

5. Prohibited Conduct

You may not:

  • Use our services for unlawful purposes
  • Harass, threaten, or abuse staff or clients
  • Attend sessions under the influence of substances when it impairs participation or safety
  • Attempt to access unauthorized systems or data
  • Record, screenshot, or distribute session content

Violation may result in immediate discharge from services.

6. Payment, Fees & Billing

You agree to:

  • Pay all fees associated with your treatment
  • Receive a Good Faith Estimate under the No Surprises Act
  • Be responsible for charges not covered by insurance
  • Pay late cancellation or no-show fees if applicable

We reserve the right to update fees with reasonable notice.

7. Termination of Services

We may terminate services if:

  • You complete treatment
  • You request discharge
  • You require a higher level of care
  • You repeatedly miss appointments
  • You violate safety or conduct policies
  • You engage in threatening or abusive behavior

You will receive a discharge summary and referrals when appropriate.

8. Emergency Procedures

Telehealth is not appropriate for all emergencies. If you are in immediate danger, call 911.

During sessions, if we believe you are at risk, we may:

  • Contact your emergency contact
  • Contact local emergency services
  • Initiate a welfare check
  • Implement a safety plan

9. Intellectual Property

All website content, materials, forms, and documents are the property of Marula Rehab Telehealth. You may not copy, distribute, or reproduce them without written permission.

10. Limitation of Liability

Marula Rehab Telehealth is not liable for technical failures, unauthorized access due to user negligence, losses caused by misuse of services, or third-party service interruptions. Our liability is limited to the maximum extent permitted by Utah law.

11. Governing Law

These Terms are governed by the laws of the State of Utah.

All vendors must sign a Business Associate Agreement (BAA).

If a breach occurs, we will notify you within required timeframes and provide steps to protect your information. We will notify regulators when required by law.

11. Special Accommodations & Accessibility

We provide ADA-compliant accommodations, assistive technology support, language interpretation services, and accessible communication formats. Requests may be made through our Special Accommodations Administrator.
